4 Criminal Newfoundland Sealers Convicted in Provincial Court of Jumping Season Updated: Tuesday, August 15 9:48 AM NT CBC News Four Newfoundland men have been convicted of killing seals before last year s hunt legally opened in the Gulf of St. Lawrence. A surveillance flight observed the four men on March 28, 2005, a day before the scheduled opening of the hunt in the region. A fisheries officer used high-powered photo and video equipment to monitor the four men. Fisheries officers from Rocky Harbour and St. Anthony boarded the vessels when they docked at Port Saunders two days later. The four men convicted in Corner Brook provincial court were Harlan Warren and Perry Warren, both of Margaree; Glen King, of Fox Roost; and Norman King, of Burnt Islands. Each man was fined $1,500. As well, Harlan Warren was fined $500 for failing to carry an at-sea observer. All of the illegally caught pelts were forfeited, at a value of $9,071. The convictions were entered in court on June 5, although the Department of Fisheries and Oceans Canada did not announce them until Monday. NFLD Newfoundland - More than Ten fishermen from Newfoundland and Labrador were convicted of selling blueback seal pelts nearly 13 years ago. However, due to the loose enforcement and poor managment of the Seal Hunt by the Canadian DFO, the sealers go away with it and were never sentenced for over 13 years. However, they will be finally be sentenced next month. The men were charged in November 1996 for selling bluebacks to a seal processing plant after an investigation by the Department of Fisheries and Oceans. Bluebacks are hooded seals that haven’t shed their blue coats. Under a law that came into effect in February 1993, it is illegal to sell bluebacks. Over 100+ sealers were implicated, and had committed these crimes. Many got away and are still at large. Out of the final 11 caught, four of them are photographed here, and the convicted Canadian killers are named: Patrick Shelley, Terry King, Derrick Pinksen and Dyson Sacrey. This is akin to the Whitecoat Law which made killing white coated infant neonatal harp seals with white coats a criminal offense. Pro-Sealers often falsely try to quote this law, as if just "saying" a law exists somehow means it "doesn’t happen". For example, a pro-sealer will attempt to argue "We don’t kill baby seals anymore, because there’s a law against it." which has been debunked and shown False. For instance, murder is "against the law" too, but that doesn’t mean it never happens. So if you ever see anyone attempt to cite the Whitecoat law of 1986 or the Blueback Law and use that to try to assert that baby seals aren’t killed by Seal Clubbers anymore, you will now be armed with the evidence that this falsehood has been debunked. This criminal court case is a clear example that disproves the assertion. The fact that Canadian Sealers still illegally slaughtered and even sold thousands of illegal baby seal pelts which were explicitly covered by this Federal law, even AFTER it had been in effect, for years, is clear documented proof that just because the law exists, it does not mean that Canadian Sealers are not still committing the Offence. This case is well-documented and recorded into provincial court evidence. Therefore, this also establishes the fact that showing pictures of Bluebacks and Whitecoats in order to raise awareness of the Seal Hunt crimes is perfectly valid, as contrary to their claims of it not happening anymore, this demonstrates that it does still happen, even after laws are in effect. This establishes the perfectly valid reason to display images of any and all types of seals, including whitecoat and blueback images, because Canadian sealers did in fact kill millions of whitecoats, and they’ve done it for decades, therefore it is perfectly valid to display them and to also write "NEVER FORGET!" in order to always remember what these perpetrators did and have still been doing for decades. The same men, who killed whitecoats by the thousands are still there, the same sealers who killed whitecoats for decades are still out there killing seals. And the same ones convicted for killing these bluebacks are still out there every year on the ice as well. So displaying images of any and all seals, including white coats, bluebacks, young ones, old ones, any ones, is completely and perfectly justified in light of overwhelming criminal evidence against these perpetrators, who continued to kill even seals that were protected by Law. The men were found guilty. And will be sentenced March 20. Nevertheless, proving what observers have been saying all along, and showing that the seal hunt is poorly enforced and sealers are rarely punished by Canadian authorities their defence lawyer, Averill Baker, says she will be requesting an absolute discharge for the multiple convicted Canadian men. Despite the fact that scores of Sealers were decisively convicted of these crimes. Canadian Seal Clubber arrested. Sealer Clyde Avery of Hillview, Trinity Bay, NL was convicted in Clarenville Provincial Court on June 8 of hunting seal during a closed time and fined $1,000. On April 6, Mr. Avery, a Newfoundland Sealer who calls himself a "Fish Harvester" was apprehended in Hillview, NL, by provincial conservation officers as he landed ashore and was carrying Firearms off his boat. Mr. Avery provided a statement in which he admitted to hunting for seal during a closed time. Canadian Sealers already have jobs and earn the majority of their income as Fishermen during the regular fishing season. Coastal fishermen and atlantic communities do Not rely on the Seal Hunt for significant income. Sealing is already their 2nd job. Sealers actually earn tens of thousands of dollars in their primary job as Fishermen. Sealing is 2ndary. And these Atlantic Coastal Fishermen also receive payment checks in the form of UI from the government of Canada every month. The government takes money from 30 million canadians and reduces the paychecks of other Canadians, and already gives it to these Sealers and fishers. Fishing and Sealing is "seasonal". Meaning it is only conducted during a small window of time during the year. Fishermen make tens of thousands of dollars during fishing season only lasting 1 or 2 months. The entire rest of the year the government compensates these men, sending them money taken from the elderly, regular workers, normal hard-working Canadian citizens, and everyone throughout Canada, through heavy taxes. And the Fishermen Sealers receive these checks for sitting at home up to 10 months of the year. The Canadian government pays them during the time the fish are not "in season" because the fishermen complain that they can’t fish and therefore can’t work during that time, and therefore needed to receive "unemployment insurance" for Not fishing. Likewise, Sealing is supposed to be conducted only during Sealing season, conducted much like fishing or hunting season. Nevertheless, these fishermen and sealers routinely violate Federal law, breaking the federal MMR guidelines, and continue to poach seals and skin them and sell them. This is a Federal crime, however as in this example, only a handful are ever caught or convicted. The hunt is loosely and poorly regulated. Dozens of incidents continue, and only token cases such as this are ever brought to fruition, mainly to keep up appearances. By prosecuting 1 case every so often, the officials of the hunt can cite the pittance of actual cases and attempt to use it as an "example" of how they closely and tightly manage and regulate the hunt meanwhile scores of violations are overlooked, let off, and escape to go free and continue to commit violations. Not content to simply kill hundreds of thousands of seals during the federally approved season, Canadian Newfoundland sealers have been caught poaching even more seals, out of season, outside the Federally approved time. These unlawful kills go un-monitoried and are rarely if ever counted toward the reduction of the numbers of seals. These criminal killers are armed, possess weapons and firearms, and are still out there, not caught, and free to commit these acts again. Even in this case, this convicted sealer was merely given a hand tap and is still lurking out there, roaming the communities in Newfoundland. He is armed. his weapons were never confiscated and he is now loose in Newfoundland, Canada. The seal hunt is a financial and economic loss to the nation of Canada, and the damage that Sealers inflict on the Canadian people, including criminal offenses, trials, monetary losses, international disdain, bringing stink on Canada’s flag, world disgust, boycotts, costing the nation jobs and business, is staggering. Even though the seal hunt continues to be a failure, and merely to support a tiny special interest group of extremist killers who bring stink upon the 30 million good Canadians and befoul the entire nation. Another Sealer Convicted of Sealing Crimes - Killing Seals During a Closed Time, Breaking Federal Law, and Possession of Illegal Weapons Ammunition June 6 ST. JOHN’S, NL - Yet another Newfoundland Canadian seal killer Lloyd Hart of Fogo was convicted in Gander Provincial Court on May 24 of sealing while the season was closed and possession of illegal .22 caliber ammunition. Mr. Hart was fined a total of $1,500. The judge ordered the illegal ammunition and 93 Harp seal pelts, valued at $9,765, be forfeited to the Crown. Fishery officers from the Twillingate detachment boarded Mr. Hart’s vessel “Sea Lance II” on April 15, 2006. At that time, the officers discovered several boxes of .22 caliber ammunition and Harp seal pelts. Upon execution of a Search Warrant, and further inspection of the vessel in the port of Fogo, fishery officers discovered an additional 80 boxes of .22 caliber ammunition. Once again, the reason this type of weapon and ammunition is illegal is that it is improper, insufficient for use, banned, and it results in agony for the targeted being. Under Federal Law even .22 calibre powered weapons and ammunition are illegal. An animal’s hide and skull is too thick for such light sealer ammunition to go through, so the targeted being suffers multiple painful wounds, leaving the animal writhing. It is insufficient to kill the animal and is akin to death by a thousand papercuts, or killing someone by the use of thumb tacks. In addition, what happens then, is that the pain causes the animal to flee. The animal is trying to flee for its life and to get away from the organism that is attempting to harm it. And this then results in what is known as “struck & lost”. The animal fights for its own life trying to get away, and all it knows is to try and make for the water. When the animal is struck with a such a weak sealer with such a weapon, the seal slips into the water, and there it suffers in agony with open wounds. The Sealer’s instrument is impotent and is ineffectual in dispatching it soon enough for the killer to retrieve its body. So it either goes through its life penetrated by Lead, or, the wounds get infected and bacteria from the water get into it and lead to its slow agaonizing death, Thus, these types of weapons have been outlawed. Sealers know this, and are aware of the regulations. This is Federal Law and it is a requirement to be completely informed of such regulations in the Federal MMR before one goes sealing. However many sealers have no regard for the lives of the targeted being, and as long as they can get away with it, ignore the fact that their acts can end up torturing the organism. Sealers have also been caught passing illegal .22 caliber weapons between seal killers behind the backs of Fisheries Officers and Observers, using conduits on board the boat to pass illegal weapons to eachother. In other instances, some observers have been caught complicit in the illegal acts and not only did officials turn a blind eye to the use of illegal weapons, they tampered with and destroyed evidence (carcasses) that harbored proof of the use of illegal 22 caliber weapons. Thus exemplifying that the oversight and management of the seal hunt is rife with corruption, and not well monitored, and loosely managed. IMPORTANT NOTE: It is important to note once again, that Canadian sealers do Not rely on seal hunting as their primary income-this is false. Sealers are often also already Fishermen. These individuals already have 2 jobs. These men make thousands and tens of thousands of dollars of income by Fishing. They already have jobs as Fishermen. They do Not rely on sealing astheir main livelihood or as their most significant income for their family. This impression is often pushed, but in the end debunked. Also, keep in mind, that seals are Not killed due to “eating all the cod”. This is a fake myth. If you ever see anyone say that, then that person is actually going AGAINST sealers themselves. The “seals eat all our cod” line has been exposed as Fraud. A pro-sealer attempting to assert that is actually going against the Canadian Sealing Association itself: “No one blames seals for the collapse of the fish stocks,” says Tina Fagan of the Canadian Sealers’ Association. These are the words direct from the Sealers’ Association itself on the subject. So anyone trying to write that they are blaming seals for the collapse of the codfish has just gone against those that actually conduct the hunt itself. that person is exposed, and their assertions may be ithrown out and the perpetrator of the “codfish-scam” postings can be decisively ignored. Also, beware of individuals attempting to assert that convictions of Sealers on Federal crimes and then letting them off and allowing them to go sealing again means that the hunt is “well-regulated”. The seal killer convicted above was let off with only a fine and is back out roaming the streets of Newfoundland. Many sealers, are let off with a wrist-tap, let go, some let off with penalties for killings that are no greater than the fine a person would get for a ticket from a parking meter. In addition, for every 1 arrest, or conviction, with subsequent release, there are literally thousands and thousands of additional vilations and crimes committed. Even ones caught on photographs, and on videotape which go unpunished. Except for a small handful of ‘token’ cases across many decades, hundreds and thousands of criminal acts have gone overlooked, and contrary to press releases to the contrary succinctly disproved by video evidence, the hunt is loosely controlled, not well-managed, and quite poorly regulated. This is well-known by anyone knowledgeable on the subject. The man above was let go, and in fact is free to go sealing again. In a string of offences, another criminal seal killing offender identified as Robert Lebouthillier of Caraquet, (N-B) Magdalen Islands - Îles de la Madeleine has been caught by authorities and convicted. The man attempted to lie to authorities regarding the number of killings, the amount of seals taken, skewing reporting records, failing to report hauls truthfully, and jumping season by Seal hunting during a closed time. All violations of Federal Law and non-compliance with licence conditions. The Magdalen Islands perpetrator Robert Lebouthillier has been convicted by court judge Embert Whittom and sentence with fines of $3,000, forfeiture of seized seal pelts, and now under surveillance of the Vessel Monitoring System for a two-year period for all fishing activities. Another Canadian Seal killer, identified by the name of Absalom Chambers, inhabiting Plum Point in Eastern Atlantic Canada, has been caught failing to follow the terms of Federally issued sealing license.“ NEWS: Another Sealing Criminal going under the name of “Absalom Chambers” is the latest in a long string of Canadian seal killers in Newfoundland caught failing to follow the rules, opening up yet another incident of possible skinning alive. 2008 Fisheries authorities from the St. Anthony detachment of the DFO, on routine patrol caught the man breaking the rules of the Seal Hunt. The culprit, named Absolom Chambers inhabits the area near Plum Point, Newfoundland, Canada. The man failed to follow the procedures for assuring the seal was not still alive before skinning it and thus violated and failed to follow the guidelines set into law by the Federal Marine Mammal Regulations and stipulated by officially sanctioned sealing licences. The procedure entails exsanguinating the seal first. This means bleeding it out. This is a procedure required by Federal law. The procedure was mandated after numerous sealers were captured on film violating humane practices by skinning seals while potentially still alive. And the procedure was handed down from the top, by the Federal DFO and government, following egregious evidence of violations reported by observers, and also as implementation of the EFSA, IVWG, and CVMA scientific reports. Reports show numerous Canadian sealers had begun cutting, pelting and peeling the skin off seals while they were still alive. To combat this sealing crime, Federal law mandates that all sealers cut the arteries under the flipper in order for it to bleed out first, before scalping it. Even though horrible in itself, it at least shortens the amount of time the animal continues to suffer, and it is meant to confirm that the animal is not still alive when its own skin is being pulled off. Yet sealers often are caught not even properly following this procedure. Absalom Chambers is one such individual caught, arrested, and convicted of this crime. While on routine patrol near Blue Cove, DFO enforcement officers caught Absalom Chambers cutting into and beginning to pelt seals without following the Law. Upon additional inspection, it was determined that Mr. Chambers failed to bleed a harvested seal, which is a violation of seal licence conditions. Despite being found, tried, and convicted, for a crime that potentially has penalties of fines upwards of $100,000.00 prison time, due to the poor enforcement and lax management of the seal hunt by Canada, the man was only fined $100.00. The Low fines and token penalties have once again exposed the frivolous enforcement and coddling surrounding the Canadian seal hunt. The man was let go. And this individual who beat in the head of a seal, cut it open, and possibly skinned seals alive and peeled the skin off their bodies is now roaming the rural areas and communities of Eastern Canada. Animal welfare and the harp SEAL HUNT CRIMES in Atlantic Canada : Aerial Surveillance catches Canadian Seal Killers Poaching Vessel - DFO NFLD TAC CVMA Criminal Canadian seal poaching vessel GREEN ISLE has been caught during a surveillance operation by Authorities. April 12 Canadian seal poacher, and offender Lindsay Small of Grand Falls-Windsor was captured during a surveillance operation by Federal Authorities while he attempted to poach seals out of an unauthorized Area in contravention to Federal Law. The man has been convicted in court. The convict Lindsay Small’s sealing vessel ‘Green Isle’ was seen actively participating in the hunt inside seal fishing area 11, which was closed and therefore unauthorized and illegal under Federal Law. The Canadian seal poacher was caught by surveillance plane and caught again later that same day by Fishery Officers from the St. Anthony Detachment on patrol by helicopter. The offender was convicted in Plum Point Provincial Court for hunting seals during a closed time. The court assessed fines, including $500 on November 26. The Low fines and token penalties have again raised questions as to favoritism by the Canadian system in coddling Sealers and Seal hunt offenders. Eyebrows were raised once again amid the smell of Seal Hunt corruption as the loose enforcement of the seal hunt by the DFO fisheries system in Canada was exposed. The man was let go and he is now at large in Newfoundland and his vessel was released and the poacher and his vessel are still loose in sealing areas in Eastern Canada.
