Legislative ban still a possibility overthere. I suppose that tiered pricing would still be acceptable as long as each tier gives a flat rate.

This is an indirect push of ISPs to implement bandwidth throttling than by-bit pricing, I think. That is not that bad in my opinion, if implementation cost is not very high. Anyone can use the bandwidth as long as there is no congestion, and the premium customers are more likely to be able to keep using the bandwidth than lower-tier customers, because the bandwidth throttling kicks-in later for the premium customers. Not too bad, I would say.
