Ok, so the offer to distribute is the standard for the lawsuit to proceed, not the infringement per se.

Distribution, by the way, is usually a handing of a copy from one to many others. What happens on the Internet is actually different - people make copies every time a file is (so-called) "distributed."

Copyrighted works are expressions of ideas, and therefore is a speech. That is one issue I can think of with this lawsuit. If you take that part literally, DMCA allows any software distribution/ provision on the ground that it is a speech and therefore protected. But obviously that is not what DMCA aims at achieving. It is rather clear that some speeches are restricted as a result of the law, and exactly which speeches are restricted could be up for a debate.

Warner is the smallest of the majors, if I remember right, and it is a reason to move first. It was Warner that has earlier complained about RIAA, I recall.
