        <title><![CDATA[SSRN-Real Copyright Reform by Jessica Litman]]></title>

        <description><![CDATA[Abstract:     
A copyright system is designed to produce an ecology that nurtures the creation, dissemination and enjoyment of works of authorship. When it works well, it encourages creators to generate new works, assists intermediaries in disseminating them widely, and supports readers, listeners and viewers in enjoying them. If the system poses difficult entry barriers to creators, imposes demanding impediments on intermediaries, or inflicts burdensome conditions and hurdles on readers, then the system fails to achieve at least some of its purposes. The current U.S. copyright statute is flawed in all three respects. In this article, I explore how the current copyright system is failing its intended beneficiaries. The foundation of copyright law’s legitimacy, I argue, derives from its evident benefits for creators and for readers. That foundation is badly cracked, in large part because of the perception that modern copyright law is not especially kind to either creators or to readers; instead, it concentrates power in the hands of the intermediaries who control the conduits between creators and their audience. Those intermediaries have recently used their influence and their copyright rights to obstruct one another’s exploitation of copyrighted works. I argue that the concentration of copyright rights in the hands of intermediaries made more economic sense in earlier eras than it does today. The key to real copyright reform, I suggest, is to reallocate copyright’s benefits to give more rights to creators, greater liberty to readers, and less control to copyright intermediaries.

        <title><![CDATA[Forever Minus a Day? Calculating the Optimal Term of Copyright.]]></title>

        <description><![CDATA[The optimal term of copyright has been a matter for extensive debate over the last decade. Based on a novel approach we derive an explicit formula which characterises the optimal term as a function of a few key and, most importantly, empirically-estimable parameters. Using existing data on recordings and books we obtain a point estimate of around 15 years for optimal copyright term with a 99% condence interval extending up to 38 years. This is substantially shorter than any current copyright term and implies that existing terms are too long.

        <description><![CDATA[The goal of the Draft Law is to provide librarians and their legal advisers with practical ideas to help them  understand and influence the policy making process when national copyright laws are being revised.  It is directed toward developing countries, from which the majority of eIFL’s membership is drawn.  But there is much for all of us, in the US and the EU as in the developing world, to learn from this document.  Its clear set of definitions and the explanatory notes that accompany each exception and limitation make it ideal for gaining a synoptic view of the state of international copyright law.  Most important is the consistent focus on the public interest and the socially beneficial purpose that copyright law is intended to serve.

        <title><![CDATA[Quantitative Study of the Impact of Research Funders' Open Access Mandates - Georgia Tech's Institutional Repository]]></title>

        <description><![CDATA[A year after the Wellcome Trust inaugurated its pioneering open access publications mandate in 2005, it commissioned SHERPA to undertake a quantitative study of how well publishers' existing policies were complying with its requirements. The study was based on a bibliography of 3,766 journal articles emanating from Wellcome Trust funded projects, and these were checked against copyright policies registered in the SHERPA/RoMEO database. The results revealed that 70% of the articles could have complied with the mandate, with only 5% definitely not complying. Since 2005, over 40 further research funders have also implemented open access mandates. Publishers have responded by adjusting their open access policies and/or introducing hybrid paid OA schemes in order to accommodate or even exploit funders' mandates. The resulting landscape is not a level plain. There are several ways in which a publisher may or may not comply with funders' rules. This paper will outline the results of the original quantitative study, and then compare this with a re-analysis of the data set against publishers' current revised policies. This will show how the level of theoretical compliance with the Wellcome Trust mandate has changed, and reveal the qualitative differences in how compliance is achieved or evaded. This theoretical compliance can then be compared with actual compliance. More generally, the paper will show how the landscape has changed over the past three years, and provide evidence for deciding whether or not funders' open access mandates have been a step in the right direction.

False copyright notices appear on modern reprints of Shakespeare's plays, Beethoven's piano scores, greeting card versions of Monet's Water Lilies, and even the U.S. Constitution. Archives claim blanket copyright in everything in their collections. Vendors of microfilmed versions of historical newspapers assert copyright ownership. These false copyright claims, which are often accompanied by threatened litigation for reproducing a work without the owner's permission, result in users seeking licenses and paying fees to reproduce works that are free for everyone to use.

The following section reviewed copyright and licensing issues of concern to the authors and to universities. The final two sessions looked toward the future, specifically, at what publishing may be in the future and what constitutes a publication in the digital environment.

        <description><![CDATA[So let’s abandon copyright in science. What does it gain us? Almost nothing, unless you author a successful textbook. Nowhere else is copyright the slightest use to a scientist and its stands in their way at every step. There are faculty who can’t use their own research work in teaching. There are libraries which can’t let the world see their theses. There are librarians who spend their time negotiating deals with publishers so they can access their own work. Even Laputa could not have designed the bizarre copyright system.
